Should I send the Collection Agency $10 per month?

Making a nominal payment to a collection agency in hopes of avoiding a lawsuit is the wrong thing to do.  Such an act may do much more harm than good.

This is a common question at my law firm. A potential client calls and says that they have defaulted on a credit card account. After I explain what their options are, they inevitably ask “Can’t I just send them $10 per month? If I do that, then they cannot sue me, right?” Wrong! This is a myth of the highest proportions. For reasons that I cannot explain, consumers often believe that it is better to send something, no matter how small, on an account that they have defaulted on, than to make the collection agency prove their case.

Credit Card Laws in PA

Know your rights and obligations under Pennsylvania Law if you have defaulted on a credit card account.

Credit Card collection lawsuits are rapidly increasing in Pennsylvania, especially with the down economy. The volume of phone calls and emails that I receive on this topic is astounding. What I have discovered is that many people do not know their rights or how to handle these situations. I can say with certainty that contacting a Consumer Attorney is a very good move. Unfortunately, many people call me after the credit card company or collection agency has a judgment against them. Had they called sooner, I might have been able to help them.

Dog Bite Injuries, Finding Insurance Coverage

The Florida is a strict liability state. By state law, a dog owner is strictly liable when their dog bites someone.

The Florida is a strict liability state. By state law, a dog owner is strictly liable when their dog bites someone. Other states have what is known as the one bite rule, which does not impose liability upon the dog owner until after they are aware the dog has bitten someone in the past. While Florida’s strict liability statute holds the dog owner responsible, finding adequate insurance coverage to compensate for the damages the animal caused may be more challenging.
